The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has reserved its order on the maintainability of the petition filed by Cellular Operators Association of India (COAI) seeking cancellation of GSM spectrum held by Tata Teleservices Limited (TTSL) and Tata Teleservices Maharashtra Limited (TTML).

Appearing before the TDSAT bench, the COAI?s council stated that the government had implemented the February 2, 2012 judgement of Supreme Court selectively by canceling only 122 2G licences issued in 2008 instead of 144 licences.

However, counsel representing TTSL and TTML questioned the very maintainability of the petition on the grounds that Supreme Court?s order is applicable to only those licences which were issued under the Department of Telecommunications (DoT) first-come, first-serve policy. The counsel added that Tata Group companies were granted GSM spectrum under DoT’s dual-technology regime of 2007 and thus, are not part of the Supreme Court?s order.
