
Siddharth Behura, former secretary, Department of Telecommunications (DoT) has requested the Delhi High Court to grant him bail on grounds of ?parity?.
Behura?s advocate informed Justice V.K. Shali that, “Sanjay Chandra, Vinod Goenka, both indicted in the case, have been granted bail. I should also be released on the grounds of parity and parity alone.?
The advocate further said that the Central Bureau of Investigation (CBI) was making an illegal and hostile distinction among the individuals involved in the case on the grounds of private and public servants.
“The CBI has created a category that is called public servants, which is unknown to law. In the trial court, the CBI did not oppose the bail requests of five persons charged in the second charge sheet and it did not mention the public servants category,? he said.
He added that even section 409 (criminal breach of trust) of the Indian Penal Code was applicable to all and did not limit itself to public servants.
