
The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has dismissed Reliance Communications? (RCOM) petition against the Department of Telecommunications (DoT) on the 2G spectrum auction guidelines.
TDSAT stated that RCOM?s petition was not maintainable given that the 2G spectrum auction guidelines issued by DoT are currently not final and binding on the operators. However, it has directed DoT to expeditiously address issues related to 2G spectrum guidelines raised by RCOM.
Earlier, RCOM had approached TDSAT against DoT on the grounds that the 2G spectrum auction guidelines issued by DoT on July 3, 2012, were discriminatory. RCOM stated that the DoT?s decision to allow GSM players to bid for two slots of 1.25 MHz spectrum as against CDMA players being allowed to bid for only one slot in the 1.25 MHz spectrum will result in a non-level playing field for the telecom operators.
