Reliance Jio Infocomm Limited (RJIL), has written to the Department of Telecommunications (DoT), opposing the Telecom Regulatory Authority?s (TRAI) proposal to introduce a flat spectrum usage charge (SUC) of 3 per cent against the adjusted gross revenue (AGR), reported by the operators.

Currently, SUC charges levied on operators vary between two to eight per cent. The existing SUC is linked to the quantum of spectrum held by an operator. RJIL in its letter to DoT, has termed TRAI?s suggestion to introduce flat SUC charges as ?arbitrary, discriminatory and legally untenable.?

According to RJIL, TRAI?s proposal if accepted will have an adverse impact on RJIL. As per the revised regulations, the company will be liable to pay SUC at 3 per cent of its AGR. However, RJIL claims that as per the Notice Inviting Application floated by the government for the auction of broadband wireless access (BWA) spectrum in 2010, the company having won the licence is liable to pay SUC at 1 per cent.
