Ram Jethmalani, senior counsel for Unitech in the 2G spectrum issue, has told the Supreme Court that advancing the cut-off date for the receipt of applications for licences and spectrum was not a clandestine decision, but one taken because of the lack of spectrum for all applicants.

He added that there was no evidence that his client, Sanjay Chandra, former chairman, Unitech Wireless, met former Minister of Telecommunications and IT, A. Raja. Also, he said that there could not be a judicial review of the government policy.

Prior to this, the Department of Telecommunications (DoT) had, in September 2007, said that it would accept applications for allocation of 2G licence and spectrum up to Oct 1, 2007.

Thereafter, on Jan 10, 2008, DoT said that only applications received by September 25, would be considered for a 2G licence and spectrum.
