Unitech Wireless has denied the charges of ineligibility to get 2G license, according to news reports. The operator has said that it complied with all the guidelines and has requested a personal hearing to present its case.

Prior to this, the company was issued a show cause notice by the Department of Telecommunications questioning why its license should not be terminated on account of non-compliance with Clause 9 of the guidelines, among others.

Unitech Wireless said it had increased its authorised capital to Rs 100.5 million and had informed the Registrar of Companies (RoC) of the same, accordingly. The showcase notice, issued to Unitech Wireless’ Mumbai circle, alleged that the company did not have authorised capital of more than Rs 0.5 million on the date of application.

In a letter to the DoT, Unitech said, “The applicant was in compliance of the requirement of Clause 9 of the guidelines and its paid up capital was Rs 100 million, as on the date of making the application for the UAS License as the authorised capital of the Applicant stood increased to Rs 100.5 million.”

This was passed through at the EGM held on September 20, 2007 and the information was sent to the RoC on October 6, 2007, it added.

The company, which has also submitted a 4,800 pages-reply, including various documents and filings, said, “We deny the sustainability and merits of the said charges and state that the charges are untenable on facts and in law and state that the SCN merits immediate withdrawal. We specifically request you that we be given an opportunity of a personal hearing in order not to militate against our rights and to demonstrate to your satisfaction that not only were we fully compliant with the eligibility criteria laid down under the guidelines at the time of making of the Application of the UAS License on September 24, 2007, but that we are a serious telecom service provider having an enviable and pioneering footprint in the business in a short time after February 2008, when we were granted the UAS License.?
