According to Telecom Disputes Settlement and Appellate Tribunal (TDSAT), Telecom Regulatory Authority of India’s (TRAI) directive that enabled users to port out of their network via SMS request, irrespective of value of their tariff offer and plans requires no interference. This statement by TDSAT comes in the backdrop of the dismissal of a petition filed by Vodafone Idea Limited (Vi).
As per TDSAT, the order issued by TRAI – regarding enabling users to port out their network via SMS request irrespective of value of their tariff offer and plan – is within its powers and does not require any interference. Earlier, TDSAT was hearing Vi’s appeal against the TRAI directive.
Moreover, TDSAT mentioned that the interpretation or meaning of the ‘Regulations 4 and 5(1) of MNP Regulations’ as urged by TRAI does not have any substantial effect upon the regime of forbearance in matters of tariff formulation.
TDSAT found the stand of TRAI to be fair and reasonable. To this end, it has also asked TRAI to provide a reasonable time to the appellant (Vi) to implement the impugned directions for all its subscribers, irrespective of the value of the tariff offers/vouchers.
