
The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has turned down Bharat Sanchar Nigam Limited?s (BSNL) petition to direct Reliance Communications (RCOM) and Tata Teleservices Limited (TTSL) to furnish the call data record (CDR).
The petition has been dismissed on the grounds that earlier the Supreme Court in its ruling on the issue had clearly mentioned the period for levying interconnection usage charges (IUC) on the two operators between November 2004 and August 26, 2005. According to TDSAT, following the Supreme Court?s judjement on the issue, the question of reopening the matter does not arise.
In April, 2008, the Supreme Court had held that the Walky services of TTSL and Unlimited Cordless services of RCOM as mobile phone and not as fixed land line. The Supreme Court had directed both the operators to pay IUC charges to BSNL.
Subsequently, BSNL approached TDSAT to direct TTSL and RCOM to provide CDR between February, 2004 and November, 2004 for levying IUC. Both the operators opposed BSNL?s move and contended that it was not entitled for CDR for the said period.
