
Swan Telecom, Videocon and Shyam Telecom have told the Supreme Court that if it decides to cancel their spectrum licence, it should be done retrospectively, say news reports. This, according to the players, is because the spectrum has been allotted under the same policy that applied to older players.
Vodafone Essar and Aircel have strongly opposed this view. According to senior advocate Abhishek Manu Sighvi, appearing for Vodafone and Aircel, the companies had invested money in the sector between 1994 to 2003, whereas the new players came into being in 2008, only after obtaining spectrum and were availing the benefits of a developed market.
He added that the additional spectrum issued to Vodafone and Aircel beyond 6.2 MHz was legal.
