The Department of Telecommunications (DoT) has issued guidelines for the surrender of administratively assigned spectrum to telecom service providers (TSPs) with access service authorisation. As per the guidelines, the applicants have to submit the request for surrender of administratively assigned frequency carriers to DoT not before 60 days prior and not later than 30 days period to the proposed date of surrender.

The rules further state that the applicants shall submit a certified proof of payment regarding payment of spectrum charger up to the previous quarter of the date of application either on provisional/final assessment basis or self-assessment basis. Charges that are sub-judice may be excluded. 

As per the rules, the Wireless Planning and Coordination (WPC) Wing of DoT is required to issue the necessary letter to the applicant firm regarding taking surrender on record within 30 calendar days from receipt of application under intimation to the Wireless Finance (WPF) Wing of DoT, to consider the date of surrender for computation of necessary spectrum charges thereafter. 

The surrendered spectrum shall be made available for further frequency assignment to any TSPs from the actual date of surrender as per procedure. Also, the equipments covered in the surrendered carrier frequency assignment can be utilised for the other valid frequency assignment in same or other licensed service area (LSA). Alternatively, the disposal of the equipments shall be as per extant rules issued from time to time.
