The central government is believed to have moved the Delhi High Court stating that WhatsApp was treating Indian users differently from its European users with regard to opting out of its new privacy policy.

The central government has said that this differential treatment of Indian users and unilateral subjection of them to the change in privacy policy by WhatsApp is a matter of concern for it.

During the hearing, the government’s legal representative informed the court that by not giving Indian users the option to opt out of sharing their data with other companies of Facebook, WhatsApp prima facie appears to be treating users with an “all or nothing approach”.

With regard to this, the government has already sent a communication to WhatsApp seeking certain information.

The Delhi HC has now listed the matter for hearing on March 01, 2021.
