The Department of Telecommunications (DoT) has approached A S Chandhiok, the Additional Solicitor General for India to seek a legal opinion on 3G roaming pact between operators, say news reports.

DoT has requested Chandhiok to comment on whether it can   restraint operators like Bharti Airtel, Vodafone India and Idea Cellular from offering 3G services beyond their licensed circles through mutual roaming pacts.

Earlier a three division bench of Telecom Disputes Settlement and Appellate Tribunal (TDSAT) had given a split verdict on the issue. The operators had challenged the government?s directive asking them to stop intra circle 3G roaming services.

DoT has also sought Chandhiok?s opinion on whether it can levy penalty on the operators which are offering 3G services in circles where they hold only 2G licences, as violation of the licence agreement.
