NCLAT stays DoT’s show cause notice to RCOM

The National Company Law Appellate Tribunal (NCLAT) has stayed a show cause notice issued by the Department of Telecommunications (DoT) to Reliance Communications (RCOM) to withdraw the operator’s licence and spectrum for the Mumbai circle. In addition, the NCLAT has also asked the DoT to not invoke bank guarantees regarding the spectrum dues. The NCLAT will now hear this case on April 8, 2019.

The move comes after RCOM defaulted on its spectrum payment worth Rs 210 million on the deadline date of March 13, 2019, which included a 10 day grace period. Apart from this, RCOM also has to pay two other instalments of Rs 2.81 billion and Rs 4.92 billion in April.

The operator had reportedly informed DoT that it was under a payment moratorium from an earlier appellate order and therefore its licence cannot be revoked.
