ICA urges TRAI to reconsider draft rules regarding derecognising of select mobile phones

The Indian Cellular Association (ICA) has asked the Telecom Regulatory Authority of India (TRAI) to reconsider draft rules which requires telecom operators to derecognise mobile phones that do not support apps enabling customers to choose the calls and messages they wish to receive.

According to the ICA, such a directive goes beyond the jurisdiction of the TRAI, which doesn’t oversee handset manufacturers. The association stated that TRAI intent to regulate devices and operating systems lacks precedent.

Section 34 of the proposed regulation on unsolicited calls makes it compulsory for all devices to provide access to call logs and SMSs required for the functioning of do-not-disturb (DND) mobile apps. The section gives TRAI the authority to direct operators to derecognise devices that do not permit functioning of such apps from its network.

Implementation of the proposed rules is expected to happen in six months. Meanwhile, the draft rules are open feedback till June 18, 2018. A final call will be taken by TRAI after considering all views.
