Madras High Court dismisses Vodafone India’s plea challenging TRAI’s tariff listing order

June 05, 2018

The Madras High Court has dismissed Vodafone India's plea challenging the Telecom Regulatory Authority of India's (TRAI) mandatory listing of tariffs on its website, including segmented offers. The court advised that the operator approach the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) instead.

The court has also asked the TRAI to abstain from taking any coercive action against the carrier for three weeks. TRAI had argued that the high court was not the right forum for Vodafone to appeal against its move, which was part of a larger order on predatory tariffs issued in February 2018.

The high court bench, too, had in an interim order in March 2018 told TRAI not to take any penal action against Vodafone, and stayed the regulator's demand that the carrier put all its tariff plans on the website, including those offered to retain individual customers.

The TDSAT, which has been moved by Bharti Airtel and Idea Cellular, has stayed the order in an interim ruling.
