Tower providers to be considered as licensees under RoW rules, confirms DoT

In a big move, the Department of Telecommunications (DoT) has clarified that tower providers will be considered as licensees under the right-of-way (RoW) rules. This has been a major demand of the industry ever since the rules were released.

The move has been welcomed by the industry and will help help infrastructure providers to set up the base for future technologies including 5G. Industry body, Tower and Infrastructure Providers Association (TAIPA) has lauded the government’s decision. As per TAIPA, the move reinforced and recognised that infrastructure providers were an essential part of the overall telecom ecosystem.

The RoW rules allow online filing of applications to ease the hassle faced in building infrastructure. They are expected to help companies get land from state governments and local bodies within a stipulated timeframe, with standard procedures outlined for telecom companies and government authorities.

The DoT had issued rules on setting up of telecom towers and laying of cables in November 2016. The rules provided a framework for granting approvals and settling disputes in a time-bound manner, as well as improving coordination between companies and government authorities. However, tower and infrastructure providers had been kept outside the purview of the regulation even though they are crucial in setting up infrastructure.
