HC terms CCIs probe into Vodafone Group for inter-connect default as abuse

The Delhi High Court (DHC) has termed the Competition Commission of India’s (CCI) decision to investigate Vodafone Group for default in providing inter-connection points to Reliance Jio Infocomm Limited (RJIL) as abuse.

The court has sought the CCIs and RJILs replies on Vodafone Group’s plea challenging the CCIs order. Further, the DHC has also sought responses from Bharti Airtel, Idea Cellular and Vodafone India, all of whom have been accused by RJIL of not providing inter-connection points. The case is scheduled to be heard by the court on April 23, 2018.

Vodafone Group moved the high court and challenges the CCIs decision in a bid to be deleted as a party from the proceedings. According to the group, the high court had in July 2017 directed the CCI to examine the plea and pass a speaking order, which was not issued. In cognisance of no speaking order being passed, the court questioned how a holding company was responsible.

Vodafone also challenged the CCIs order directing an investigation into the foreign entity. Meanwhile, the order of CCI has been set aside by the Bombay High Court but the CCI moved the Supreme Court in January 2018 for the same.
